1. Acceptance of Terms

By downloading, installing, or using the Changed application ("App") or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Changed Labs ("Changed," "we," "us," or "our"). Please read them carefully before using our Service.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 13, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet all eligibility requirements.

The Service is not available in jurisdictions where it would be prohibited by applicable law. By accessing the Service, you confirm that your use complies with all laws in your jurisdiction.

3. Your Account

To access certain features of the Service, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable local, national, or international law or regulation.
• Transmit any unsolicited or unauthorized advertising or promotional material.
• Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to it.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use automated tools (bots, scrapers, crawlers) to access or interact with the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

5. User Content

The Service may allow you to input, upload, or store personal wellness data, journal entries, habit logs, and other content ("User Content"). You retain all ownership rights in your User Content.

By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the Service. We will not sell your personal User Content to third parties.

You represent and warrant that your User Content does not violate any third-party rights or applicable laws.

6. Intellectual Property

The Service and its original content, features, and functionality — including but not limited to text, graphics, logos, icons, images, audio clips, and software — are and will remain the exclusive property of Changed Labs and its licensors.

The Changed name, logo, and all related marks are trademarks of Changed Labs. You may not use our trademarks without our prior written consent.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your information.

The App is designed with your mental wellness in mind. We treat your personal data with the highest level of care and apply privacy-by-design principles throughout the Service.

8. Payments & Subscriptions

Certain features of the Service require a paid subscription ("Plus" or "Pro"). By subscribing, you authorize us to charge the applicable fees to your payment method on a recurring basis until you cancel.

All fees are stated in US dollars and are non-refundable except as required by applicable law or as expressly stated in these Terms. We reserve the right to modify pricing at any time with reasonable notice.

You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

The Changed app is a wellness and self-improvement tool and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Changed Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) $100 USD.

11. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time from within the App settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via the App or by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
